These Terms of Service (“Terms”) govern your access to and use of the website mangacomicke.com and related services (collectively, the “Services”) operated by MangaComicke (“we”, “us”, “our”).
By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility and accounts
You must be able to form a legally binding contract under applicable law to use the Services in ways that require an account or purchase. Where sign-in is offered (for example through Google), you are responsible for maintaining the security of your account credentials and for activity under your account. You agree to provide accurate information and to update it as needed.
2. The Services
MangaComicke offers an online catalog of manga, manhwa, comics, and light novels, tools to browse and save items, and flows to request purchases or custom orders. Features may change over time. We may suspend or discontinue any part of the Services with reasonable notice where practicable.
3. Orders, pricing, and availability
Product listings, descriptions, images, and prices are provided for information and may contain errors or become outdated. We reserve the right to correct mistakes, refuse or cancel orders (including after confirmation) when an offer was clearly erroneous, a product is unavailable, or we suspect fraud or abuse. Prices and fees may change until your order is confirmed according to our process.
Placing an order or request through the site does not guarantee fulfillment until we confirm availability, pricing, and delivery or pickup arrangements with you where applicable.
4. Custom orders
Custom or special requests are subject to supplier availability, licensing, and import rules. We may decline requests we cannot fulfill lawfully or commercially. Timelines and quotes provided are estimates unless we state otherwise in writing.
5. Payment and delivery
Payment methods, timing, delivery, and pickup options are those we communicate when we confirm your order or as shown on the Services. You agree to pay all charges associated with your order as agreed at confirmation. Risk of loss and title for physical goods pass according to the arrangement we confirm with you (for example at delivery or pickup).
6. Returns, refunds, and cancellations
Return, refund, and cancellation rights depend on the product, condition, and applicable law. Unless mandatory consumer rights apply, we handle returns and refunds according to our policies as communicated at purchase or by support. Contact us promptly if there is a defect, damage in transit, or wrong item.
7. Seller program
If you participate as a seller, additional terms, policies, or agreements may apply (including onboarding rules, commissions, and conduct requirements). Conflicts between those documents and these Terms will be resolved as stated in the more specific agreement; otherwise these Terms remain in effect for general use of the site.
8. Acceptable use
You agree not to misuse the Services, including by: violating law; infringing intellectual property or privacy rights; transmitting malware or spam; scraping or automated access that harms the site; circumventing security; impersonating others; or interfering with other users’ use. We may investigate and take action, including removing content or terminating access.
9. Intellectual property
The Services, branding, and original content we provide are owned by MangaComicke or our licensors. Product titles, cover art, and related materials may be owned by publishers or rights holders; their display does not grant you a license beyond personal viewing and ordering through us. You may not copy, modify, or distribute our site or its materials except as allowed by law or with our written permission.
10. Third-party services
The Services may integrate or link to third parties (for example authentication, hosting, email, or payment providers). Those services are governed by their own terms and privacy notices. We are not responsible for third-party services we do not control.
11. Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted or error-free.
12. Limitation of liability
To the fullest extent permitted by applicable law, MangaComicke and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Services or inability to use them.
Our total liability for any claim arising out of or relating to these Terms or the Services shall not exceed the greater of (a) the amount you paid to us for the specific transaction giving rise to the claim in the twelve (12) months before the claim, or (b) where no payment applies, fifty United States dollars (USD 50) or the equivalent in local currency, unless mandatory law requires otherwise.
13. Indemnity
You agree to indemnify and hold harmless MangaComicke and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services, your content, or your violation of these Terms or applicable law, except to the extent caused by our willful misconduct.
14. Governing law and disputes
These Terms are governed by the laws of Kenya, without regard to conflict-of-law rules. Courts in Kenya shall have exclusive jurisdiction over disputes, subject to any mandatory rights you have as a consumer in your country of residence.
15. Changes
We may modify these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. Continued use after changes constitutes acceptance, except where your explicit consent is required by law.
16. Severability and entire agreement
If any provision is held invalid, the remainder stays in effect. These Terms, together with the Privacy Policy and any order-specific confirmation or seller terms that apply to you, constitute the entire agreement regarding the subject matter.
